Smulie Co. Ltd. ("Smulie", "we", "us", or "our") operates Simpia, Pianify and related Smulie websites and mobile applications, including https://hi.smulie.io/ (together, the "Service").
This Privacy Policy explains how we collect, use, disclose, retain, and protect personal data when you use the Service. It also explains the choices and rights that may be available to you depending on where you live.
The Service is designed to help people learn and practice music through interactive tools, educational content, and AI-assisted features. We aim to collect only the data reasonably needed to operate, improve, secure, and support the Service.

1. Scope

This Privacy Policy applies to personal data processed by Smulie through the Service. It does not apply to third-party websites, platforms, app stores, payment providers, advertising networks, social networks, or content providers that may be linked from, integrated with, or used in connection with the Service. Those third parties process data under their own terms and privacy policies.

2. Personal Data We May Collect or Process

The categories of data we collect or process may vary by app, platform, country, feature, account status, and device settings. We may collect or process the following categories:
Account and contact data: name, email address, user ID, account settings, login method, and customer support identifiers.
Profile and preference data: profile photo, display name, learning preferences, favorite genres, skill level, language, country or region, app settings, and other information you choose to provide.
Subscription and purchase data: subscription status, purchase history, product identifiers, transaction metadata, renewal status, refund status, and app-store receipt information. We do not receive your full payment card number from Apple, Google, or other payment processors.
Device and technical data: device type, operating system, app version, browser type, IP address, country or approximate region, device identifiers, advertising identifiers where permitted, Firebase installation ID or similar identifiers, and diagnostic data.
Usage and app activity data: lessons opened, practice activity, feature interactions, session duration, performance events, crash logs, diagnostics, and aggregated product analytics.
On-device audio and MIDI data: microphone audio signals processed locally on your device for real-time piano recognition, MIDI events, timing data, note detection, and practice feedback data needed for piano recognition or MIDI device features.
Bluetooth permission data: device connection signals needed to detect and connect external MIDI devices where you enable Bluetooth-based features.
User content and communications: content you submit, record, upload, post, or send to us, including support messages, survey responses, feedback, and reports.
Marketing and attribution data: campaign source, referral information, ad interaction data, opt-in marketing preferences, and similar measurement data where permitted by law and platform rules.
Cookies and website data: cookies, pixels, local storage, and similar technologies used on our websites for basic functionality, analytics, security, preferences, and measurement.
We do not intentionally collect sensitive personal data such as government ID numbers, precise financial account details, racial or ethnic origin, political opinions, religious beliefs, health data, or biometric identifiers unless we clearly disclose the need for that data and have an appropriate legal basis.

3. Audio Processing

For piano recognition and practice feedback features, the Service processes microphone audio signals in real time on your device using audio-recognition technology researched and developed by Smulie. Microphone access is used solely to recognize piano notes and provide immediate learning feedback during lessons or practice.
Raw microphone audio from piano recognition is processed locally on the device. Smulie does not upload, transmit, store, sell, or share raw microphone audio recordings from piano recognition features on our servers. After a lesson is available on your device, piano recognition and practice feedback can function with or without an internet connection.
Audio-derived events, such as detected notes, timing, practice progress, or performance metrics, may be processed to provide feedback, save progress, improve app functionality, troubleshoot issues, and support the Service.

4. How We Use Personal Data

We may use personal data for the following purposes:
to provide, operate, personalize, and improve the Service;
to create and manage accounts, subscriptions, purchases, and customer support;
to deliver lessons, practice feedback, progress tracking, and AI-assisted learning features;
to detect notes, process MIDI input, connect compatible devices, and support music-learning functionality;
to maintain security, prevent abuse, debug errors, detect fraud, and protect users and Smulie;
to analyze app performance, feature usage, crashes, retention, and product quality;
to send service messages, account notices, support replies, and important updates;
to send marketing communications where permitted and to honor opt-out choices;
to measure ads, campaigns, referrals, and product adoption where permitted;
to comply with legal obligations, app-store requirements, platform policies, tax, accounting, and dispute-resolution needs;
to enforce our Terms of Service, Copyright & Content Rights Policy, and other applicable policies.

5. Legal Bases for Processing

Where laws such as the GDPR, UK GDPR, Singapore PDPA, Vietnam personal data protection rules, or similar laws apply, we rely on one or more legal bases depending on the activity:
Contract: to provide the Service, subscriptions, account features, support, and requested functionality.
Consent: for permissions, marketing, cookies where required, certain analytics or advertising activities, and optional features that require your permission.
Legitimate interests: to improve the Service, secure our systems, prevent misuse, understand product performance, and operate our business, where those interests are not overridden by your rights.
Legal obligations: to comply with law, tax, accounting, app-store, regulatory, or valid legal requests.
Vital or public interests: only where applicable law permits and the circumstances require it.
You may withdraw consent where processing is based on consent. Withdrawal does not affect processing that occurred before withdrawal or processing that continues under another lawful basis.

6. How We Share Personal Data

We may disclose personal data to the following categories of recipients:
Service providers and processors: hosting, cloud infrastructure, analytics, crash reporting, customer support, email delivery, security, attribution, testing, content delivery, and internal operations providers.
App stores and payment providers: Apple, Google, and other payment or distribution platforms that process purchases, subscriptions, refunds, and receipts under their own terms.
Advertising and measurement partners: where permitted by law and platform rules, for ad delivery, attribution, fraud prevention, campaign measurement, or frequency control.
Platform integrations: third-party login providers, video platforms, embedded content providers, MIDI or device integrations, and similar services when you use those features.
Professional advisers: lawyers, accountants, auditors, insurers, and other professional advisers.
Authorities or legal parties: courts, regulators, law enforcement, government authorities, or other parties when required by law or necessary to protect rights, safety, and security.
Business transfers: parties involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, subject to appropriate safeguards.
We do not sell personal data for money. Some analytics, advertising, or measurement practices may be considered "sharing", "targeted advertising", or a "sale" under certain privacy laws. Where those laws apply, you may exercise available opt-out rights as described below.

7. Third-Party SDKs and Services

The Service may use third-party SDKs and services for analytics, crash reporting, performance monitoring, attribution, advertising, subscriptions, app-store functionality, login, and customer support. The exact providers may vary by app version, platform, region, and feature set.
We review third-party services based on the role they play in the Service and the data they process. We expect third parties that process personal data for us to use it only for permitted purposes and to provide appropriate protection. Third-party platforms may also act independently under their own privacy policies.

8. Cookies and Similar Technologies

Our websites may use cookies and similar technologies to:
operate the site and remember preferences;
improve security and prevent misuse;
understand usage and performance;
measure campaigns and referrals;
support advertising or marketing where permitted.
You can control cookies through browser settings and, where available, cookie preference tools. If you disable cookies, some parts of the Service may not work correctly.

9. Your Choices

Depending on the Service and your device, you may be able to:
update profile and account information in the app;
cancel subscriptions through Apple App Store, Google Play, or the relevant purchase platform;
disable push notifications in device settings or app settings;
limit ad tracking through iOS, Android, browser, or platform settings;
opt out of marketing emails using the unsubscribe link or by contacting us;
disconnect third-party login or social integrations through the Service or the third-party platform;
request account deletion or personal data deletion by using in-app tools where available or by contacting us.
Deleting the app from your device does not automatically cancel an app-store subscription. You must cancel subscriptions through the relevant app store or purchase platform.

10. Your Privacy Rights

Depending on where you live, you may have rights to:
request access to personal data we hold about you;
request correction of inaccurate data;
request deletion of personal data;
request restriction or objection to certain processing;
request portability of certain data;
withdraw consent where processing is based on consent;
opt out of targeted advertising, sale, or sharing where applicable;
lodge a complaint with a data protection authority.

Some requests may be limited by legal, security, fraud-prevention, technical, accounting, tax, dispute-resolution, or operational requirements.

11. California Privacy Notice

If you are a California resident, California privacy laws may provide additional rights, including the right to know, access, correct, delete, and opt out of certain sharing or targeted advertising activities.
The categories of personal information we may collect are described in Section 2. The purposes for collection and use are described in Section 4. The categories of recipients are described in Section 6. We retain personal information as described in Section 13.
We do not knowingly sell personal information of users under 16. We do not use sensitive personal information for purposes that require a separate right to limit use under California law unless we provide the required notice and choice.
If our advertising or measurement activities are considered a "sale" or "sharing" under California law, you may opt out by using device-level ad tracking controls where available and by contacting us at hello@smulie.io.

12. Children and Minors

The Service is not intended for children under 13, and we do not knowingly collect personal data from children under 13 without appropriate parental consent. If the law in your country requires a higher age for consent to online services, you may use the Service only if you meet that age requirement or have appropriate parent or guardian consent.
If you are a parent or guardian and believe that a child has provided personal data to us without appropriate consent, please contact us at hello@smulie.io. If we confirm that we collected such data in a way that requires deletion, we will take reasonable steps to delete it.

13. Retention

We retain personal data for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Service, maintain records, comply with legal obligations, resolve disputes, prevent fraud, enforce agreements, and support security.
Retention periods vary depending on the type of data and the reason for processing. For example:
account data is generally retained while the account is active and for a reasonable period afterward;
subscription and transaction records may be retained for tax, accounting, refund, and dispute purposes;
analytics and diagnostic data may be retained in aggregated or de-identified form;
support communications may be retained to handle follow-up requests and improve support quality;
backup copies may remain for a limited period before deletion according to our backup cycles.

14. International Transfers

Smulie is based in Singapore, and our service providers may process data in Singapore, the United States, the European Economic Area, Vietnam, and other countries. These countries may have data protection laws that differ from those in your location.
Where required, we use safeguards designed to support lawful international transfers, such as contractual protections, technical safeguards, and other measures required or permitted by applicable law.

15. Security

We use administrative, technical, and organizational measures designed to protect personal data, including encryption in transit, access controls, monitoring, and secure development practices. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice as required by law or platform rules. The updated version will be effective when posted unless a different effective date is stated.
